Sweepstakes Official Rules

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS SWEEPSTAKES IS INTENDED FOR PLAY IN THE UNITED STATE ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATE AT TIME OF ENTRY.

 

By entering this Sweepstakes, entrants accept and agree to be bound by these Official Rules, and the decisions of PODS Enterprises, LLC (“Sponsor”) which are final and binding in all respects. Any violation of these rules may result in disqualification.

 

1. Sweepstakes Period.  The Sweepstakes begins at 12:00 AM EST on June 11, 2024 and ends at 11:59 PM EDT on June 30, 2024 (“Sweepstakes Period”).  There is only one “Entry Period” as set forth below:

2. Eligibility. The Move Freely Sweepstakes (the “Sweepstakes”) is only open to legal residents of the 50 United States and District of Columbia who are at least 18 years old as of the date of entry.  Employees, contractors, officers, directors, of Sponsor, its parent, affiliates, subsidiaries, distributors, sales representatives, retailers, and advertising, promotion and judging agencies, and members of the immediate family (i.e., parents, children, siblings, spouse and their respective spouse) and household of such persons are not eligible to participate. This Sweepstakes is void outside the 50 United States and the District of Columbia, and where prohibited.

 

3. How to Enter.  (1) By Obtaining a PODS Quote:  During the Sweepstakes Period, you will automatically receive one entry into the Sweepstakes by obtaining quote from Sponsor for a long-distance move involving the shipment of Sponsor’s container(s) between two locations by calling the Sponsor’s call center at 855-706-4758. (2) Enter For Free Via Mail: Enter for free and without obtaining a PODS quote by hand-printing your name, daytime telephone number, street address and your e-mail address on a 3” x 5” card and mailing in an envelope with proper postage affixed to PODS Enterprises, LLC, 13535 Feather Sound Drive, 4^th Floor Clearwater, FL 33762, Attn: Move Freely Sweepstakes- Marketing, to be postmarked by the End Date and received by Mail Received By Date (set forth in Paragraph 1). All entries become property of Sponsor and will not be acknowledged or returned. Limit one (1) entry per person/email address/outer postmarked envelope regardless of method of entry. Multiple entries received from any person will be void. Any other form of entry is void.  Sponsor is not responsible for lost, late, mutilated or postage due mail.  All entrant information, is subject to the Privacy Policy of the Sponsor, located at www.pods.com/privacy-policy.

 

4. Winner Selection and Notification. One potential winner will be selected in a random drawing on or about the Drawing Date (set forth in Paragraph 1).   The potential winner will be notified by mail, email and/or telephone within seven (7) days of the Drawing Date. If the potential winner cannot be contacted, does not respond within seven (7) days from the date the Sponsor first tries to notify him/her, and/or the prize notification is returned as undeliverable, prize may be forfeited.

 

5. Prizes (3)/Odds: Each winner will receive winner’s choice of a (i) $4,750 voucher good for one (1) long distance move provided by Sponsor.  ARV: $4,750. Voucher expires on July 31, 2025, and may not be applied to any moving supplies, pads, or other packing materials. Packing and loading services are excluded. Winner is responsible for any required permits, taxes, or fees, and prize is subject to the terms and conditions listed thereon and the difference in cost of the winner’s move if any part of the cost of the move is not covered by the voucher.  Limit one (1) prize per person/household.  Prizes are non-transferable and no cash equivalent or substitution of prize is offered even if entire voucher is not used.  Odds of winning depend on the number of eligible entries received for the Entry Period.

 

6. Taxes. The winner acknowledges and agrees that he/she will be solely responsible for any applicable Federal, state and local taxes, including but not limited to personal income taxes, on prize.   The winner also acknowledges and understands that the Sponsor shall issue a Form 1099 to the IRS for prizes valued over $600.

 

7. No Prize Transfer. The prize nor any portion thereof is transferable. The prize nor any portion thereof is redeemable for cash except as provided herein. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value.  Unclaimed prizes will not be awarded. 

 

8. Consent and Release. By entering the Sweepstakes, each entrant (or their parent or legal guardian if an eligible minor) agrees (and agree to confirm in writing): (a) to release and discharge the Sponsor, its affiliates, subsidiaries, retailers sales representatives, and its officers, directors, employees, agents, and any other party associated with the development or administration of the Sweepstakes, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, “Sponsor Entities”), from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of any prize, including any travel related thereto legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light); (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. Except where prohibited acceptance of the prize constitutes the consent of the winner, without further compensation, to use the name, photograph, voice and/or likeness of the winner for advertising and publicity purposes by the Sponsor and/or others authorized by the Sponsor, in any and all media now known or hereinafter invented without territorial or time limitations and without compensation. Any potential winner may be required to sign an affidavit of eligibility (including social security number) and a liability/publicity/copyright release. Affidavits and releases must be returned within seven (7) days from the date that Sponsor first tries to notify the potential winner, or prize may be forfeited.  Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor’s parent or legal guardian who must sign and return all required documents.  Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants. 

 

9. Applicable Laws and Jurisdiction. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. By entering, entrants agree that all issues concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by the laws of the State of Florida, without giving effect to any choice of law or conflict rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Pinellas County, Florida.

 

10. Winner List. For a list containing the name of the winner, send a self-addressed stamped envelope, by the date set forth in paragraph 1 above, to: Move Freely Sweepstakes Winner List, PODS Enterprises, LLC, 13535 Feather Sound Drive, 4^th Floor, Clearwater, FL 33762.
